Any person or entity (“User”) visiting, using or otherwise accessing the site at www.acousticarchitect.com (the “Site”), together with all products, data and other materials contained in the Site (“Content”), agrees to and is bound by the following terms and conditions of this agreement (“Agreement”):
This Site (www.acousticarchitect.com), together with the Content is owned or controlled by Augmented Arts S.R.L., on behalf of Silviu Ivașcu, str. G-ral Toma Ghenea, nr. 13, VAT Number RO 38977585, J03/769/2017. Augmented Arts S.R.L. is referred to in this Agreement as “we”, “us”, “our” or “Acoustic Architect”.
Ownership of Content: Augmented Arts S.R.L., unless otherwise stated, owns or controls all rights in the Site and the Content, including all audio packs, sample packs, sound libraries, sample libraries, sound toolkits and other sound suites (“Product”). You may not publish, distribute, extract, re-utilize, or reproduce any part of the Site or its contents in any form (including storing it in any medium) other than as expressly allowed herein or as permitted by law.
User License: When you purchase a Product from Augmented Arts S.R.L., you are purchasing a License (“User License”) to use those sounds within your own musical compositions, whether your musical works are for commercial release or not. By purchasing products sold via this website, you automatically become bound to the terms of the User License.
This User License grants you a non-transferable, lifetime, royalty-free license to use those sounds within your own musical compositions. This means that only the purchaser has the right to use the sound in a commercial capacity.
- You can use the sounds in combination with other sounds within your musical or sound design works.
- You can release such compositions commercially without further payment of fees or royalties.
- You cannot give or resell your purchased sound libraries.
- You cannot place the collection on any file sharing network.
- You cannot use the sounds in isolation (i.e. when not within a musical composition or sound design work) as part of a commercially released project
- You cannot use the sounds to make another Sample Pack, or any audio sample collection.
- You cannot use the sounds in isolation for sound effects on a website, on any kind of multimedia, audio or video production, unless as part of a musical performance or in composition with other sounds.
You agree and acknowledge that Augmented Arts S.R.L. has a proprietary interest in all sound recordings on or within the Site and that any use by you that frustrates the purpose of this Agreement or circumvents the revenue model of Augmented Arts S.R.L. (including without limitation selling, renting, or otherwise using or distributing un-integrated Content) would likely cause irreparable loss in a way that could not be adequately compensated by damages.
Trade Marks: The brands, products and service names used in this Site (including without limitation, “Silviu Ivașcu” and “Augmented Arts S.R.L.”) are the trade marks or trade names of Augmented Arts S.R.L. or its partners unless otherwise stated. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or taglines without prior written permission. To be clear, you may not use Silviu Ivașcu’s name in reference to any composition you create using the Products purchased from this site without prior written permission.
Disclaimer: Use of the Site and Content is entirely at your own risk. The Site and Content may be inaccurate and is subject to change at any time. We reserve the right to change these Terms on a going-forward basis at any time, effective as of posting. Please check these Terms periodically for changes. All services and contents of the Site are provided without any representations or warranties of any kind, either implied or express, to the fullest extent permitted by applicable laws. In addition, we do not represent or warrant that the Site or its contents will be free of defects, including without limitation viruses or other harmful elements. We cannot be held responsible for damage to any equipment, hardware or software arising from the use of any sounds or any type of data files downloaded from the Site. We cannot be held responsible for any such injury or damage resulting from sounds downloaded from the Site.
Limitation of Liability: User agrees that the liability of Augmented Arts S.R.L. to User under this Agreement shall be limited to the amount User has actually paid to Augmented Arts S.R.L. for its services.
Indemnity: User agrees to indemnify Augmented Arts S.R.L. for any loss or damage that may be incurred by Augmented Arts S.R.L., including without limitation legal fees, arising from User’s use of the Site or User’s use of any information obtained through the Site.
Severability: If any part, term, or provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.
No Partnership: Your use of the Site and/or its Content creates no partnership, client, fiduciary or other professional relationship.
Refund Policy: As our products are downloadable we are unable to provide customers with refunds unless there is a proven fault with the product. Please make sure when you are making a purchase that it is what you want, as mistakes cannot be seen as a reason for refunds.
